Terms & Conditions

These terms cover the use of beerVote.me and the purchase of votes on it. By voting you accept them. There is no account to register, so this is the whole of the agreement between us.

What a vote is

A vote is one ranking point, added to one beer, on this site. That is the entire product. It is bought and counted immediately, and there is nothing to download, install, log into or receive by post.

• One vote — €0.60.
• Super Fan — €3.00 for 10 votes, all cast for the same beer.

Every vote counts the same, wherever it was bought from. There is no way to buy a position, only votes — and everybody else can buy them too.

What a vote is not

• It does not buy a position. Where a beer ends up depends on what everybody else votes for, and a beer can be overtaken the minute after you vote.
• It gives you no ownership of, or say in, the beer, the brewery, the ranking or this site.
• It cannot be transferred, resold, exchanged, moved to another beer, or accumulated towards anything.
• It is not a review or an endorsement, and it is not an entry into a competition with a prize.

Who you are paying

Votes are sold by Jens Kafitz, whose full details are on the legal notice. The payment itself is taken through Stripe, who process the card on our behalf and whose terms apply to that part; the charge appears on your statement as BEERVOTE.ME. Anything about the order — a receipt, a refund, a charge you do not recognise — is for us, not for Stripe.

Delivery

Votes are counted as soon as Stripe confirms the payment, which is normally a few seconds. Because those are two separate journeys across the internet, you may briefly see a screen saying the vote is still being counted — the vote is safe at that point; it is counted from the payment, not from that page.

If a payment is confirmed and the votes are still not showing after a few minutes, write to mail@beervote.me with your receipt and it will be put right.

Right of withdrawal

Consumers in the EU normally have fourteen days to withdraw from a distance purchase. By buying a vote you expressly ask for it to be counted immediately, and you acknowledge that once it has been counted you lose that right — the vote is in the ranking and cannot be taken back out of it.

Refunds

Because a vote is delivered the moment it is paid for, all sales are final except where the law says otherwise.

Refunds may still be given for duplicate purchases, billing errors, fraudulent transactions, votes that were paid for and never counted, or simply at our discretion. Nothing here limits any right you have under consumer law that cannot be excluded. Refund requests go to mail@beervote.me.

A refunded vote is removed from the ranking.

Taxes

The price you see is the price you pay. Nothing is added at checkout: a €0.60 vote is charged at €0.60 wherever you are. Questions about a payment are for us — the address is on the legal notice.

Adding a beer

Anyone can add a beer that is missing, free and without an account. In doing so you confirm that what you enter is accurate as far as you know and that you have the right to submit it, and you allow it to be published on this site.

Entries may be edited, merged with a duplicate, or removed. Do not add:

• anything that is not a real beer;
• anything unlawful, abusive, defamatory or deliberately misleading;
• advertising, links, or anybody’s personal information;
• a second spelling of a beer or brewery that is already listed.

Fair use of the ranking

Do not attempt to manipulate the ranking other than by buying votes: no automated voting, no attempt to interfere with how votes are counted, no abuse of payment or refund processes, and no scraping or automated load that gets in the way of ordinary visitors.

Votes obtained fraudulently — including through chargebacks or stolen cards — will be removed, and the beers and entries involved may be removed with them. No refund is due for a vote removed on those grounds.

The ranking is an opinion

Positions on this site reflect nothing but how many votes visitors have paid for. They are not a measure of quality, safety, popularity in the real world, or commercial success, and nothing here is a statement of fact about any brewery or its products. The ranking is offered for entertainment.

Beer and brewery names are the trademarks of their owners, used here to identify the beers being ranked. This site is not affiliated with or endorsed by any of them.

Availability

The site is offered as it is. There is no promise that it will be available without interruption or free of errors, and it may be changed or withdrawn. Where anything goes wrong with a purchase, our responsibility is limited to the amount you paid for the votes concerned — nothing in these terms limits liability that cannot lawfully be limited.

Changes to these terms

These terms may change. The current version is always the one on this page, and the date at the top says when it last moved. The terms that apply to a purchase are the ones in force when you made it.

Law

Belgian law applies, and the courts of Belgium have jurisdiction. If you are a consumer, this does not deprive you of the protection of the mandatory rules of the country you live in, nor of the right to bring a claim there.
